General Terms and Conditions of the Fundador Super Special Promo “Gusto ko ‘yan!” Campaign

PROMO MECHANICS

Fundador Super Special Promo ‘Gusto ko ‘yan!’ is brought to you by Emperador Distillers, Inc. (“EDI” or “Sponsor”).

  1. PROMO AND REDEMPTION PERIOD:

The promo period will run from September 1, 2025 – February 28, 2026. Participants may redeem their prizes throughout the promo period and until March 14, 2026 (“Extended Redemption Period”), at designated redemption locations. The full details will be made available on the Sponsor’s official website www.fundadorsuperspecialpromo.com

  1. ELIGIBILITY:
  1. Eligible participants (“Participants”) must be at least 18 years old.
  2. Eligible Participants must be a resident of the Philippines.
  3. Employees of Emperador Distillers, Inc., including employees of its parent company and subsidiaries and affiliates, employees of Tesla and other third-parties involved in this promo, employees of the FDA, and their relatives up to the second degree of consanguinity or affinity are disqualified from joining this promo. 

III. HOW TO JOIN:

  1. Participants should buy any of the participating Fundador SKUs.
  2. Participants must check under the cap to see if it is a marked cap for a chance to win exciting prizes.
  3. Details of how the marked cap will be verified and authenticated by the Sponsor or the redemption center (as the case may be) in order to be declared the winning cap can be found in the section below.
  4. By joining this promo, Participants agree to abide by the promo mechanics and all decisions made by the Sponsor regarding this promo. All decisions made by the Sponsor regarding the promo are final and binding.
  1. MERCHANDISE ALLOCATION AND REDEMPTION LIMITS

A total of 65,060 prizes will be available for redemption nationwide throughout the entire promo and redemption period.

Once the total allocation of 65,060 prizes has been fully redeemed, no further redemptions will be accepted, regardless of whether the promo period is still ongoing. Redemption of prizes will only be valid from September 1, 2025, to February 28, 2026, including the allowable Extended Redemption Period until March 14, 2026. Any redemption attempts beyond these dates will no longer be entertained.

All prizes are tax-free (tax on the prizes, if any, will be shouldered by the Sponsor).

  1. REDEMPTION PROCESS FOR MINOR PRIZE WINNERS
  2. Participants with marked caps for minor prizes may proceed to any designated redemption outlet, as listed on our official promo website: www.fundadorsuperspecialpromo.com
  3. The marked cap must be surrendered to claim the prize.
  4. No additional information or documentation will be required for bottle prizes unless otherwise requested by the redemption outlet for age verification purposes.
  5. All marked caps collected during redemption will be properly disposed of by the promo organizers.
  1. VALIDATION AND AUTHENTICATION OF MARKED CAPS FOR MAJOR PRIZES

1.

INITIAL VERIFICATION

Participants shall send a Viber message to the Sponsor and provide a picture of the marked cap, his/her name and location (city/province) from Monday to Friday (excluding holidays), during office hours from 9:00 a.m. to 5:00p.m. at 09178553128.

2.

SCHEDULE FOR FINAL VERIFICATION

Once the initial verification is concluded, the Sponsor shall provide the final authentication schedule and location. The Participant is required to bring the marked cap and bottle for the final authentication.

3.

VENUE FOR FINAL AUTHENTICATION

The final authentication shall be conducted at the Sponsor’s head office, 7th Floor, 1880 Building, Eastwood City, Brgy. Bagumbayan, Quezon City, 1110.

The final authentication shall be conducted at the Sponsor’s nearest branch or office based on proximity to the Participant’s location.

4.

FINAL AUTHENTICATION

Participant shall personally appear for identity verification, validation and authentication of the marked cap and bottle. The Participant shall present a valid government-issued ID which shows his/her birthday. In case his/her government-issued ID does not prove the age of the participant, he/she must bring additional proof of age.  The travel cost of the Participant to the final authentication venue shall be for the personal account of the Participant.

5.

SPONSOR’S DECLARATION OF WINNER

Upon validation and authentication, the Sponsor for major prizes shall declare the marked cap as the winning cap. The Sponsor shall provide a certificate to the winner on the same day at Tesla Showroom in Bonifacio Global City (BGC). The declared winner’s marked cap and bottle shall be surrendered to the Sponsor for proper disposal.

Upon validation and authentication, the Sponsor for major prizes shall declare the marked cap as the winning cap. The Sponsor shall provide a certificate to the winner and schedule the awarding of the Yamaha Mio Fazzio Motorcycle. The declared winner’s marked cap and bottle shall be surrendered to the Sponsor for proper disposal.

 

6.

AWARDING OF MAJOR PRIZES

The final authentication and awarding of major prizes will be scheduled by the Sponsor and must be attended by:

·   The winner;

·   An authorized representative of the Sponsor; and

·   A representative from the Food and Drug Administration (FDA).

This entire process is required to ensure the integrity of authentication and facilitate the logistics of prize delivery. The travel cost of the Participant to the major prize awarding venue shall be for the personal account of the Participant.

Winning Participants must sign an Acknowledgement Receipt, Waiver and Personal Data Consent Forms. The winners will be required to provide the following details for documentation purposes:

a) Full Name

b) Age

c) Contact Number

d) Email Address

 

Winning Participants may be required to present and/or submit a valid driver’s license along with one additional government-issued ID for vehicle registration and verification purposes. The cost of vehicle registration and vehicle insurance shall be borne by the winning Participant. The turnover of the actual Tesla Model Y or Yamaha Mio Fazzio Motorcycle (as the case may be)  to the winner/s shall be upon the completion of the transfer of the vehicle registration to the winner’s name.

 

VII. REDEMPTION CENTER / OUTLETS FOR MINOR PRIZES (BOTTLE PRIZES) 

All designated redemption centers and outlets where winning participants can claim their prizes will be listed on our official promo website.

VIII. CONTROLS AND MEASURES

  1. Participants and their submitted marked caps may be disqualified from the promo if found to be fraudulent, tampered with, unreadable, unverified, duplicated, or unauthorized, based on reasonable standards set by the Sponsor. If found to have copied or reproduced a winning cap, Participant/s may be subject to legal action in accordance with applicable laws.
  1. All winning caps must clearly display the official winning message and contain the required security markings as defined and verified by the Sponsor. Caps that do not meet these validation standards will be considered invalid and will not be honored.
  1. Redemptions will not be permitted beyond the official redemption period, which ends on February 28, 2026, and the two-week extension, ending on March 15, 2026. The redemption period will also close once all the prizes have been fully redeemed or awarded, whichever comes first.
  1. By participating in the promo, Participants agree to the promo terms and conditions, and grant consent for their names, images, or information to be used in the Sponsor’s announcement, marketing, advertising, or related promotional materials.
  1. All decisions made by the Sponsor regarding this promo shall be considered final and binding.
  1. LIMIT OF LIABILITY
  2. During or in connection with this Promo, the Sponsor shall not be held liable for any lost, inaccurate, corrupted, unidentifiable, damaged, or unsubmitted marked caps and bottles, including instances where a cap is found to be a duplicate, copy, or counterfeit.

In such instances, the Participant’s entry will result in immediate disqualification. The Sponsor hereby reserves its right to pursue legal action against such Participant/s in accordance with applicable laws.

  1. Neither Sponsor nor its directors, employees, agents, or suppliers will have any responsibility for any damage, loss, injury, or disappointment suffered by any Participant or any other persons entering the Promo or as a result of  an event of force majeure, an act or omission of the Participant and any third party/ies; the Participant’s inability or failure to follow the terms and conditions of this Promo or any such other analogous circumstances. By entering the promo, Participants agree that no claim shall be asserted against the Sponsor, its directors, officers, employees, or agents relating to any and all losses or injuries (including special, indirect, and consequential losses), damages, rights, claims, and actions of any kind resulting from entering the promo or acceptance, use or misuse of any prize, including, without limitation, personal injuries, demise and property damage.

X.USE OF PERSONAL DATA

For the purposes of this promo, the Sponsor will collect certain personal data from participants. Please note that failure to provide the requested information may result in the Sponsor being unable to process the entry or award the corresponding prize. Participants’ personal information will be used solely for this promo, including for vehicle registration in the case of major prizes, as well as for the Sponsor’s announcement, promotional and marketing activities. It will be processed in accordance with the  Sponsors’ Privacy Policy and the promo Terms and Conditions.   1. GOVERNING LAW

This promo and the Terms and Conditions shall be governed by the laws of Philippines, and the Quezon City, Philippine courts shall have exclusive jurisdiction to deal with all matters relating to the promo and its Terms and Conditions. The invalidity, illegality or unenforceability of any sole provision in these Terms and Conditions shall not affect the remaining provisions of these Terms and Conditions, which shall persist in full effect.
